These Terms of Use and Conditions of Sale ("Terms") govern your use of our website, including any sub-domains, affiliated websites and mobile applications (the "Website"), owned and operated by Liposomal ("Liposomal," "we," "our," "us"). By accessing, using or placing an order on the Website, you agree to these Terms. If you do not agree to all of them, you may not use the Website.

Please read carefully. These Terms include disclaimers of warranties and limitations of liability (Sections 13 and 14), and a mandatory arbitration and class action waiver (Section 15) that affects your right to a court hearing, a jury trial and class actions. You can opt out of arbitration within 30 days of purchase. We may update these Terms by posting changes on this page, and continuing to use the Website after changes are posted means you accept them. By using the Website and agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence, that you have the legal capacity to enter into a binding contract with us, and that you have read, understood and agreed to these Terms.

3. General conditions & user conduct

All parts of the Website are protected by U.S. and international copyright, trademark and other intellectual property laws. You do not acquire any ownership or other rights by using the Website or any material on it.

4. Products for personal use only

Products you buy from Liposomal are for your personal, non-commercial use. You agree not to resell, redistribute, modify or export any product ordered from the Website. Resale outside authorized channels can make a product materially different, which may affect its safety or quality and our ability to honor guarantees. We may limit or refuse orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

5. No medical advice; accuracy of information

Material on the Website is for general information only. It is not medical advice and is not a substitute for advice from a qualified healthcare provider. Statements on this Website have not been evaluated by the Food and Drug Administration. Liposomal Lymphatic Drainage Drops are not intended to diagnose, treat, cure or prevent any disease. 6. Changes to the Website & prices

We may modify or discontinue the Website, or any part of it, at any time without notice, and are not liable to you or any third party for doing so. Some products may be available only online and in limited quantities, and are subject to refund or exchange only under our Shipping Policy and Refund Policy.

Product descriptions and prices may change at any time without notice, at our sole discretion. Any offer is void where prohibited.

7. Payment

By submitting payment information, you confirm that you are authorized to use the card or account, that the information is complete and accurate, that you are responsible for any payment card fees, and that sufficient funds are available.

We and our payment providers may receive updated card information, such as a new card number or expiration date, from your card issuer, and will update your account accordingly. Your card issuer may let you opt out of this updating service; contact them if you wish to do so.

We are not responsible for fees your bank or card issuer charges. If your bank or card issuer reverses a charge, we may bill you directly by another method, including a mailed statement.

8. Orders, subscriptions & cancellation

Order placement and acceptance

An order confirmation does not mean we have accepted your order. We may accept or refuse shipment to anyone for any reason. If we refuse your order, we will refund your original payment method. We are not liable for any loss resulting from our refusal to provide a product or service, and we may request additional information before processing an order.

Subscriptions and automatic payment

When you buy on the Website, you can choose a one-time purchase or a subscription. If you subscribe, your order ships and your payment method is charged automatically at the frequency you choose at checkout until you cancel. You can change your frequency in your account or by emailing liposomalsupport@gmail.com. We may use an account updater to keep your card details current, in which case renewals will be billed to the updated card.

If you enroll in the Liposomal subscription program and provide a valid payment method, each payment will be processed automatically at the time of each shipment and billed to the payment method you provided at enrollment.

Cancelling a subscription

You can cancel at any time through your your account on our website or by emailing liposomalsupport@gmail.com. To avoid your next shipment and charge, cancel at least 24 hours before it is scheduled to ship.

If your payment method fails for a subscription shipment, you agree that Liposomal may contact you by phone (including mobile) or email for alternative payment information. Unpaid balances for products received may be sent for collection.

9. Shipping

Liposomal ships to addresses in the United States and to many other countries. See our Shipping Policy for processing times, delivery estimates, carriers and tracking.

An accurate shipping address and phone number are required. We are not responsible for late or missing shipments caused by incorrect address information. If you need to correct or cancel an order before it ships, email liposomalsupport@gmail.com as soon as possible. We cannot guarantee that we can change an order once it has been placed.

10. Delivery confirmation

Because many things can happen at a delivery address that are outside our control, you agree that the carrier’s delivery confirmation is sufficient proof of delivery, even without a signature.

11. Money-back guarantee & refunds

Liposomal offers a 30-day money-back guarantee on purchases made directly on our website. If you are not satisfied, you can request a full refund within 30 days of your delivery date, and no return is required. Refunds are issued to your original payment method. 12. Social media

This section applies to anyone who interacts with our presence on Facebook, Instagram, YouTube, Pinterest, TikTok, X, LinkedIn or other third-party platforms ("Social Media Presence"). Those platforms are not controlled by us and have their own privacy policies and terms. Comments and opinions posted by users are their own and do not reflect the views of Liposomal, and we have no obligation to monitor or remove them. If you see an offensive or inappropriate post, report it to the platform using its own procedures.

13. Disclaimer of warranties

Except where prohibited by law, this Website and all products are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of title, merchantability or fitness for a particular purpose. 15. Dispute resolution: binding arbitration & class action waiver

You agree that any dispute or claim arising from or relating to this arbitration provision, Liposomal’s Privacy Policy or these Terms, Liposomal’s advertising or marketing, or Liposomal’s products or services will be resolved by binding, final and confidential arbitration before a single arbitrator administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. This provision is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16. Other rights you would have in court may also be unavailable in arbitration.

How to opt out of arbitration

You may opt out within 30 days of purchasing a product through the Website by mailing a letter to Liposomal, Attn: Legal Department, [your business address], stating your name, the product you purchased and that you wish to opt out of arbitration.

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Liposomal and its parent, subsidiaries, affiliates, predecessors and successors, and their partners, officers, directors, agents, representatives, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claims, actions, losses, liabilities, damages, expenses, demands and costs, including reasonable attorneys’ fees, arising from (1) your breach of these Terms or the documents they incorporate; (2) your breach of any representation or warranty in these Terms; or (3) your violation of any law or the rights of a third party.

Anything you submit or post to the Website or provide to us, including photos, testimonials, ideas, questions, reviews, comments and suggestions ("Submissions"), will be treated as non-confidential and non-proprietary. No waiver of any term by Liposomal is a further or continuing waiver of that term or any other term, and any failure by Liposomal to enforce a right or provision is not a waiver of it.

23. Severability

If any provision of these Terms is found unlawful, void or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable part will be severed without affecting the rest of these Terms.

24. Termination

If these Terms are terminated, Sections 2–5, 13–19 and 22–25, together with any representations, warranties and other obligations you have made or taken on, survive termination.

25. Entire agreement

These Terms and any policies or operating rules we post on the Website form the entire agreement between you and Liposomal and replace any prior or contemporaneous agreements. Any ambiguity will not be interpreted against the drafting party.
